Terms of Service

 

ServePointe
Effective Date: November 15, 2025

 

Welcome to ServePointe. These Terms of Service (“Terms”) govern your use of our website, services, and any legal support solutions we provide. By accessing our website or submitting a service request, you agree to be bound by these Terms. If you do not agree, please do not use our services.

ServePointe (“we,” “our,” “us”) is a California-based process serving company operating in compliance with state and local laws.

1. Scope of Services

ServePointe provides:

  • Service of process

  • Delivery of legal documents

  • Skip tracing

  • Stakeout services

  • Registered agent serves

  • Proof of Service preparation

  • Document filing (if applicable)

  • Other related services as agreed

 

We reserve the right to decline any service request at our discretion, including but not limited to requests that are unlawful, unsafe, or outside our service area.

2. Client Responsibilities

By submitting a service request, you agree that:

  1. You have the legal authority to request service of process.

  2. All documents provided are accurate, complete, and legally valid.

  3. You will provide correct and complete information, including addresses, deadlines, and instructions.

  4. You will notify us promptly if any information changes.

 

ServePointe is not responsible for delays or unsuccessful service attempts caused by incorrect or incomplete client information.

3. Service Attempts & Completion

A. Standard Procedure

Attempts are made according to the selected service level (Standard, Rush, Expedited, etc.).

B. Unsuccessful Attempts

If service cannot be completed, we will provide:

  • Attempt logs

  • Notes

  • Photos (where applicable)

  • Declaration of Due Diligence

 

Unsuccessful service does not exempt clients from fees due for attempted service, mileage, or skip tracing.

C. Substituted Service

When permitted by California law, substituted service may be performed after due diligence.

D. Completion of Service

Service is considered complete once:

  • Personal, substituted, or alternative service is executed

  • Proof of Service is prepared and delivered to the client

 

4. Turnaround Times & Cutoff Deadlines

Service levels include estimated timelines:

  • Standard: First attempt within 3–5 business days

  • Rush: First attempt within 24–48 hours

  • Expedited: Same-day attempt for documents received before the daily cutoff (2:00 PM PST); otherwise next-day priority

 

Turnaround times are estimates, not guarantees, as service depends on recipient availability, access restrictions, and other external factors.

5. Fees, Billing, and Payment

Fees for service depend on:

  • Service type (Standard, Rush, Expedited)

  • Number of attempts

  • Distance or mileage

  • Difficulty of service

  • Additional services (skip tracing, stakeout, filings, etc.)

 

Payment is due at the time of service request unless otherwise agreed (e.g., law firm invoicing).

 

All fees are non-refundable, including unsuccessful service attempts, as payment covers time, effort, documentation, and attempt logs.

Late invoices may incur additional fees.

6. Document Handling & Confidentiality

ServePointe handles all documents with strict confidentiality. We do not disclose client information except:

  • As required by law

  • To complete service

  • To prepare Proof of Service or declarations

  • To communicate with relevant parties for service attempts

 

Uploaded documents are stored securely via Wix and/or ServeManager.

7. Limitations of Liability

ServePointe is not liable for:

  • Court deadlines missed due to incomplete or incorrect client information

  • Defendant avoidance or inability to access a service location

  • Legal outcomes related to the service

  • Delays caused by traffic, weather, emergency closures, or restricted access

  • Errors in documents provided by the client

 

Our liability is limited to the amount paid for the specific service at issue.

 

We do not provide legal advice. Clients are responsible for ensuring documents are legally proper and service methods meet case requirements.

8. No Guarantee of Outcome

ServePointe does not guarantee:

  • That a subject will be available or cooperative

  • That service will be completed successfully

  • Specific timing of serves beyond best-effort estimates

  • Acceptance of service by any specific individual

 

We guarantee only that we will perform service attempts professionally and in compliance with California law.

9. Intellectual Property

All content on our website—including logos, text, graphics, images, and layout—is the property of ServePointe and may not be copied, reproduced, or used without permission.

10. Third-Party Platforms

ServePointe uses third-party platforms (including Wix and ServeManager).
We are not responsible for:

  • Their data handling practices

  • Outages

  • Technical issues

  • Changes to their terms

 

Clients agree to comply with the terms of any integrated platforms used to communicate or process assignments.

11. Termination of Services

We reserve the right to refuse, cancel, or discontinue service at any time for reasons including:

  • Unsafe conditions

  • Harassment

  • Fraudulent requests

  • Unlawful purposes

  • Policy violations

 

Clients remain responsible for payment for work already performed.

12. Changes to These Terms

ServePointe may update these Terms at any time.
 

The updated version will be posted on this page with a revised effective date.

 

Continued use of our site or services constitutes acceptance of the latest Terms.
